These terms govern your use of this website and every purchase from West Coast ATV Parts. Most of our parts are used or pre-owned — the condition, fitment, as-is, and returns sections are the ones to read closely before you order.

01Agreement to These Terms

Welcome to West Coast ATV Parts (“West Coast ATV Parts,” “we,” “us,” or “our”). We are a family-owned ATV parts business located in Damascus, Oregon. These Terms of Service (“Terms”) govern your use of westcoastatvparts.com (the “Website”) and your purchase of products from us.

By accessing our Website, placing an order, or purchasing a product from West Coast ATV Parts, you agree to these Terms. If you do not agree with these Terms, please do not use the Website or purchase products from us.

02Our Business and Products

West Coast ATV Parts sells ATV, UTV, motorcycle, powersports, and related parts and accessories.

Many of the parts offered by West Coast ATV Parts are used, pre-owned, salvaged, or previously installed components. Used parts may have normal signs of use, including scratches, dents, fading, corrosion, dirt, grease, wear, repaired areas, or other cosmetic and functional characteristics associated with previously used equipment.

Unless a product listing specifically states otherwise, products should be considered used or pre-owned.

Because used parts vary in condition, customers should carefully review the photographs, descriptions, part numbers, compatibility information, and other information provided with each listing before purchasing.

03Product Condition

We make reasonable efforts to accurately describe and photograph the products we sell. However, photographs may not show every imperfection, and minor differences between photographs and the actual product may occur.

A used part may contain wear, defects, or deterioration that is not readily visible during inspection. Unless expressly stated otherwise in writing, West Coast ATV Parts does not guarantee the remaining service life or condition of internal components of used parts.

If a listing states that a product has been tested, the testing is limited to the specific testing described in that listing or accompanying sales documentation.

04Fitment and Compatibility

The customer is responsible for determining whether a product is compatible with their specific vehicle. Make, model, year, OEM part number, manufacturer part number, interchange information, photographs, dimensions, and other information provided by West Coast ATV Parts are intended to assist with identification and are not, by themselves, a guarantee of fitment.

Before ordering, customers should verify compatibility using the appropriate OEM part number, VIN, vehicle specifications, measurements, or other applicable information.

If you are unsure whether a part will fit your vehicle, please contact West Coast ATV Parts before placing your order. West Coast ATV Parts is not responsible for a customer’s failure to verify fitment before purchasing or installing a part.

05Used Parts Sold “AS IS”

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, USED PRODUCTS ARE SOLD “AS IS,” “WHERE IS,” AND “WITH ALL FAULTS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEST COAST ATV PARTS DISCLAIMS IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Nothing in these Terms is intended to exclude, restrict, or waive any warranty, right, or remedy that cannot legally be excluded, restricted, or waived under applicable law.

Any express warranty provided by West Coast ATV Parts must be specifically stated in writing and applicable to the particular product purchased.

06No Guarantee of Remaining Service Life

Because our products may be used or salvaged components, we do not guarantee:

  • The remaining useful life of a product;
  • The number of hours or miles a product will operate;
  • That a used part will perform like a new part;
  • That installation of a part will correct a particular mechanical problem;
  • That a part will meet a customer’s particular performance requirements; or
  • That a part is suitable for racing, competition, extreme riding, commercial use, or another specialized application.

07Engines and Major Mechanical Components

Used engines, transmissions, differentials, suspension components, and other major mechanical assemblies may contain internal wear that cannot be determined through ordinary external inspection.

Unless specifically stated otherwise in writing, the sale of a used mechanical assembly does not constitute a guarantee regarding:

  • Internal wear;
  • Bearings;
  • Seals;
  • Gaskets;
  • Internal tolerances;
  • Compression;
  • Oil pressure;
  • Internal gears;
  • Internal shafts;
  • Remaining service life; or
  • Other internal components.

Any testing described in a product listing is limited to the testing actually performed and described.

08Electrical and Electronic Parts

Electrical and electronic components may be affected by installation conditions, vehicle configuration, wiring, voltage, grounding, programming, and other factors. Customers are responsible for verifying compatibility before installation.

Unless expressly stated otherwise in writing, West Coast ATV Parts does not guarantee that a used electrical or electronic component will operate in every vehicle or configuration.

09Installation

Installation should be performed by a qualified mechanic or technician when appropriate. Customers are responsible for proper installation and use of purchased products.

West Coast ATV Parts is not responsible for damage caused by improper installation, incorrect fitment, modification, misuse, neglect, improper maintenance, racing, competition, overloading, or use outside the intended application of the product.

10Orders and Payment

All orders are subject to product availability and acceptance by West Coast ATV Parts. We reserve the right to cancel or refuse an order when reasonably necessary, including in circumstances involving:

  • Product unavailability;
  • Pricing or listing errors;
  • Suspected fraud;
  • Unauthorized payment information;
  • Incorrect customer information;
  • Duplicate orders; or
  • Other legitimate business reasons.

Customers are responsible for providing accurate billing, shipping, email, and contact information.

11Prices and Product Information

Prices and product availability may change without notice. We reserve the right to correct typographical errors, pricing errors, inventory errors, product descriptions, photographs, or other Website information.

If an order is affected by a significant pricing or listing error, we may cancel the affected order and refund amounts paid for the affected product.

12Shipping

Orders are shipped using the shipping method selected or designated at checkout. Shipping and delivery dates are estimates and are not guaranteed unless West Coast ATV Parts expressly agrees otherwise in writing.

West Coast ATV Parts is not responsible for delays caused by shipping carriers, weather, natural disasters, transportation interruptions, incorrect addresses, government actions, or other circumstances outside our reasonable control. Customers are responsible for providing an accurate shipping address.

13Shipping Damage

Customers should inspect packages and products promptly after delivery. If a package appears damaged upon arrival, customers should photograph the package and product before disposing of packaging materials.

Please contact West Coast ATV Parts as soon as reasonably possible regarding damaged shipments. We may request photographs, packaging information, or other documentation necessary to investigate a shipping claim.

14Returns and Refunds

West Coast ATV Parts accepts returns subject to the terms of the applicable product listing and the following conditions.

All returns are subject to a 20% restocking fee and any shipping charges associated with the return. Customers must contact West Coast ATV Parts before returning a product.

Returned products must be the same products originally sold by West Coast ATV Parts and must be returned in substantially the same condition in which they were sold, subject to ordinary shipping inspection. A return may be denied or a refund reduced if the product has been:

  • Installed;
  • Modified;
  • Disassembled;
  • Altered;
  • Damaged after delivery;
  • Misused;
  • Missing components;
  • Exchanged for another part;
  • Contaminated by fluids or other substances; or
  • Otherwise returned in a materially different condition.

West Coast ATV Parts reserves the right to inspect returned products before issuing a refund. Refunds will be processed after the returned product has been received and inspected.

Nothing in this section is intended to eliminate any return or refund right that cannot legally be waived.

15Wrong Part or Incorrect Fitment

Customers should verify fitment before ordering. If West Coast ATV Parts makes an error in fulfilling an order, please contact us promptly so that we can investigate and determine an appropriate resolution.

If a customer orders a part that does not fit because the customer selected or identified the incorrect part, the return will be handled under the applicable return policy, including the applicable restocking fee and shipping charges.

16Chargebacks and Payment Disputes

Customers agree not to initiate fraudulent or unauthorized chargebacks or payment disputes. If a chargeback is initiated, West Coast ATV Parts may provide the payment processor with relevant order information, photographs, shipping records, tracking information, communications, invoices, and other transaction records.

Nothing in these Terms prevents a customer from exercising rights available under applicable law.

17Vehicle Safety

ATVs, UTVs, motorcycles, and other powersports vehicles can involve significant risks of injury, property damage, or death.

Customers are responsible for using purchased products safely and in accordance with applicable laws, manufacturer instructions, and appropriate safety practices. West Coast ATV Parts does not encourage reckless, illegal, or unsafe operation of any vehicle.

18Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEST COAST ATV PARTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE PURCHASE, USE, INSTALLATION, OR INABILITY TO USE A PRODUCT.

This may include, to the extent permitted by law:

  • Labor or installation costs;
  • Removal costs;
  • Diagnostic expenses;
  • Vehicle downtime;
  • Loss of use;
  • Lost profits;
  • Lost revenue;
  • Transportation expenses;
  • Damage to other property; or
  • Other consequential losses.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEST COAST ATV PARTS’ TOTAL LIABILITY ARISING FROM THE SALE OF A PRODUCT SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO WEST COAST ATV PARTS FOR THAT PRODUCT.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

19Website Use

You agree to use the Website only for lawful purposes. You may not:

  • Attempt to interfere with Website operation or security;
  • Attempt unauthorized access to our systems;
  • Submit fraudulent orders;
  • Use unauthorized payment information;
  • Copy or reproduce Website content for unauthorized commercial purposes;
  • Scrape Website content for commercial purposes without permission; or
  • Use the Website in a manner that violates applicable law.

We reserve the right to restrict or terminate access to the Website when reasonably necessary to protect our business, customers, systems, or property.

20Intellectual Property

The West Coast ATV Parts name, logo, photographs, website content, product descriptions, graphics, text, and other original materials appearing on the Website are owned by or licensed to West Coast ATV Parts unless otherwise indicated. You may not reproduce, distribute, modify, publish, or commercially exploit our content without prior written permission.

Manufacturer names, trademarks, logos, OEM numbers, and other third-party intellectual property remain the property of their respective owners. References to manufacturers or brands are for identification and compatibility purposes and do not necessarily indicate an affiliation with or endorsement by those manufacturers.

21Third-Party Services

Our Website may use third-party services for payment processing, website hosting, shipping, analytics, fraud prevention, advertising, communications, or other business functions.

Third-party services may have their own terms and privacy policies. Your use of those services may therefore be subject to additional terms imposed by the applicable third party.

22Privacy

We may collect and use information necessary to process orders, communicate with customers, provide customer service, arrange shipping, process payments, prevent fraud, maintain the Website, and operate our business. Any separate Privacy Policy published by West Coast ATV Parts applies in addition to these Terms.

23Website Security and Availability

We make reasonable efforts to maintain the Website, but we do not guarantee that the Website will always be available, uninterrupted, secure, or error-free. We may modify, suspend, or discontinue portions of the Website at any time.

24Changes to These Terms

We may update these Terms from time to time. Updated Terms will become effective when posted to the Website unless otherwise stated. Your continued use of the Website or purchase of products after updated Terms are posted constitutes acceptance of the updated Terms, subject to applicable law.

25Governing Law

These Terms and transactions with West Coast ATV Parts shall be governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise. Any dispute shall be brought in a court of competent jurisdiction in Oregon unless applicable law requires another venue.

26Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in effect.

27No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

28Entire Agreement

These Terms, together with the applicable product listing, order confirmation, invoice, return policy, Privacy Policy, and other written terms expressly applicable to a transaction, constitute the agreement between you and West Coast ATV Parts regarding your use of the Website and purchase of products, except where applicable law provides otherwise.
